There was a motion to accept the minutes of the January 7th, 2010 meeting with one correction.  The motion was seconded and accepted with a vote of 5-0-0.

Mr. Nick Alfieri’s Agent’s Report has been appended to the minutes.  


Public Hearing – Notice of Intent – 96 Populatic Street – O’Connor - CE159-991
Mr. Richard Goodreau, Engineer of United Consultants, and Mr. Thomas O’Connor, the property owner, both appeared before the Commission for the demolition of existing single-family house and reconstruction of a single-family house.

Mr. Goodreau informed the Commission members that the project entails a proposed new house which would be serviced by an asphalt driveway leading into a garage area and a walkway which would be located to provide access to the house and patio as well.

Mr. Goodreau stated that a rain garden will be constructed as a bioretention area.  The lot will be stabilized with loam and seeding in the area where the ground is presently bare.  There will be erosion control installed around the property line.  There are 11 trees which are currently located down the property line which are proposed to be removed due to safety concerns.  The applicant is proposing to plant 11 trees to provide some mitigation for the trees that will be removed.

There is some work proposed within the 0-25 ft. buffer zone and the applicant is requesting a variance for this work.  The work will consist of removal of the existing house, regrading of this area, some tree removals and plantings and stabilization of this area with loam and seeding.

Mr. Goodreau stated that the property is partially located within the flood plain to Populatic Lake and he has provided for compensation for the filling that is being proposed for the site.

Mr. Alfieri informed the applicant of 8 items to be addressed in this Notice of Intent filing.

Mr. Tom O’Connor, 98 Populatic Street, an abutter to the site, expressed the opinion that he is very pleased with this project.  The pine trees need to come down in his opinion due to their size.  He is concerned about the danger to his house due to their close proximity.

A Commission member asked if there would be a full basement and Mr. Goodreau stated that there will not be a full basement and the new proposed house will be the same size as the existing house on the site.

A Commission member stated that he is in favor of the removal of the cesspool as it will have a very positive effect upon the functions and characteristics of the wetlands.

Another Commission member requested that Mr. Goodreau give an explanation of how the elevation of the rain garden will function.

The Commission will conduct a site walk of the property on Saturday, February 20th at 10 a.m.

There was a motion to continue the hearing until February 25th so that the Commission may conduct a site walk.  The motion was seconded and accepted with a vote of 5-0-0.


Continued - Public Hearing – Notice of Intent – 30 Stonehedge Rd./The Woodlands – Scituate Federal Savings Bank - CE159-990
Mr. Richard Goodreau, Engineer of United Consultants, and Mr. Ed McLaughlin, representative of Scituate Federal Savings Bank, both appeared before the Commission for the construction of a single-family house in The Woodlands subdivision.

Mr. Alfieri recommended Special Conditions #19-34 to be appended to the Orders of Conditions for this project and these proposed Special Conditions are appended to the Agent’s Report.

There was a motion to close the public hearing for 30 Stonehedge Rd.  The motion was seconded and accepted with a vote of 5-0-0.

There was a motion to issue both State and Local Orders of Conditions with 34 Special Conditions, 19 through 34 special conditions being listed in the Agent’s Report.  The motion was seconded and accepted with a vote of 5-0-0.


Continued - Public Hearing – Amendment Request to Orders of Conditions – 6 Longwalk Road – Palladini – SE159-557
Mr. Gregory Bunavicz, Engineer of Borderland Engineering, and Mr. Chris Palladini, the applicant, both appeared before the Commission to request an Amended Order of Conditions for the construction of a single-family house.

Mr. Bunavicz informed the Commission that he has revised the plans since the last Conservation meeting and earlier this week has submitted these plans to the Conservation Office.  The  changes to the plan that were requested by the Commission members at the last meeting as well as at the recent site walk have been incorporated on these plans.

Mr. Bunavicz stated that stormwater has been directed into the rain gardens as opposed to onto the street.  There was a broken area in the stone wall on the property, which will be repaired, and this stone wall will be used as a boundary instead of concrete bounds.  As a result of this, the haybale line in this area was moved to the point of the stone wall and thus slightly increased the disturbance table by approximately 900 sq. ft.

Mr. Bunavicz informed the Commission members that the existing silt fence currently located on the property is deteriorated and will be replaced with erosion control in the appropriate location.

There is an alternative to the driveway location which is depicted on the revised plans.  There is a planting detail depicted on the revised plans showing the location of the rain garden planting locations as well as the location of the trees to be planted in the side and rear yards.

Mr. Alfieri informed the Commission members that all of his outstanding items have been addressed in these revised plans.

A Commission member stated that in the construction sequence there is no notation regarding the sign depicting the DEP number.  Also, the location of the erosion control has no Professional Engineer’s stamp approving of their location.  The limit of the detention basin within 100 ft. of the wetland should be marked with some large boulders along the rim of the basin to act as bounds and he recommended that this be made a special condition in the Orders of Conditions.  Also, as a recommended special condition, a location in the yard as to where would be an appropriate location to deposit yard waste and a location towards the detention basin away from the street would be an optimal location for this waste.  

It was also discussed with the applicant as a special condition that no lawn shall be established during water conservation periods and a log book shall be kept with 24 hour emergency phone number contacts.  There shall also be no use of phosphorous containing fertilizers in Conservation jurisdiction.

Another Commission member made suggestions regarding the plantings for the site.

The Commission requested that Mr. Bunavicz revise the plans to clarify the planting schedule and submit them to the Conservation Department before the next meeting.

There was a motion to continue the hearing until February 25th.  The motion was seconded and accepted with a vote of 5-0-0.
